There are some\ncentral elements to a negligence case, and a personal injury victim must be\nable to prove that these elements exist:<\/p>\n\n\n\n<p>\u2726 The\ndefendant owed the plaintiff a duty of care.<\/p>\n\n\n\n<p>\u2726 The defendant breached their duty of care.<\/p>\n\n\n\n<p>\u2726 If it weren\u2019t for the defendant\u2019s breach, the plaintiff would not have suffered harm.<\/p>\n\n\n\n<p>\u2726 The defendant\u2019s breached duty of care was a responsible cause of the plaintiff\u2019s injuries.<\/p>\n\n\n\n<p>\u2726 Any reasonable person would have been able to foresee the accident could have occurred.<\/p>\n\n\n\n<p>\u2726 As a result of the incident, the plaintiff suffered damages and losses.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Personal Injury Damages <\/h1>\n\n\n\n<p>Damages and losses include both economic and\nnon-economic damages. Losses that can be defined by an actual dollar amount and\nredeemed through financial compensation are considered economic damages, such\nas hospital, medical expenses, lost wages, and anything else that was a direct\nfinancial loss to the victim or their family.
