In fact, the United States Consumer Product Safety Commission reports that around this time of year, an average of 230 people visit the emergency room EVERY DAY as a result of 4th of July Holiday-related firework injuries.

The most common types of injuries reported by fireworks are burn injuries, which is why it is so vital for children of all ages to be fully supervised while playing with them. Did you know that even sparklers can reach temperatures of up to 2,000 degrees? And of course, children are the top victims of second and third degree burns caused by sparklers and similar fireworks.

Keep in mind that not all Fourth of July injuries are firework-related. Many people celebrate Independence Day with campfires, cookouts, and grilling. As a result, there are many other kinds of burn injuries, smoke injuries, and fire accidents that occur during 4th of July parties and get-togethers.

Additional types of Fourth of July injuries that are the mostly commonly reported this time of year include loss of hearing, blindness, amputations, smoke inhalation, PTSD, and shock. People have lost eyeballs, fingers, limbs, and suffered permanent scarring or disfigurement.

Important Safety Tips to Follow This Independence Day:

🎆 Monitor and assist children with fireworks at all times. Never allow children to play with fireworks alone, even sparklers.

🎆 Never keep your body parts near a firework. Maintain a safe distance, even when lighting them.

🎆 Immediately back FAR away from a firework after lighting it.

🎆 Never light multiple fireworks at once. Always light one at a time.

🎆 Have a full bucket of water or a hose that is already turned on in the case of a fire.

🎆 Always drench a firework with water before tossing it into the garbage.

🎆 Purchase and use LEGAL fireworks in Indiana.

🎆 If cooking out, monitor the grill at all times.

🎆 Position your grill in an open area away from the house and other structures.

🎆 Follow the grill’s manufacturer’s instructions for safe use.

🎆 Use long-handled grilling tools to avoid burn injuries.

🎆 Do not let children use or turn on the grill.

Hair Salon Personal Injury Claims

In the case that you suffered serious burns, abrasions, or substantial hair loss as a result of your salon stylist’s negligent services, your claim would potentially fall under Indiana’s general laws of negligence. Negligence is general is defined as a failure to use reasonable care.

In order for it to be a valid claim, certain elements must exist. These include, but are not limited to:

❶ The stylist or salon owed the claimant a duty of care.

❷ The stylist or salon breached their duty of care by action or inaction.

❸ If it weren’t for the action or inaction of the stylist or salon, the claimant would not have suffered harm.

❹ The stylist or salon’s action or inaction was the proximate cause of the claimant’s injuries.

❺ As a result of the stylist or salon’s negligence, the claimant suffered damages.

You Must Prove Your Case

As the claimant, you (and your legal team) hold the burden of proving negligence (ie. the failure to use reasonable care) in order to be awarded a judgment for your damages and losses.

Do You Have a Valid Claim?

In the case of a hair salon, the primary questions are, “Did they owe you a duty of care?”, “Did they breach this duty of care?”, and “Did that breach cause you harm?” Hair salons and stylists are not always one party since many stylists rent booths at salons and sometimes operate as independent contractors. This factor can make such claims complex, so it is vital that you speak with a licensed Indiana personal injury lawyer for proper advice and legal guidance.

Are Space Heaters Dangerous?

Continue reading to learn more about space heaters and a few safety tips to consider when using them.

Space Heater Safety Tips

There are some statistics you should be aware of before choosing to regularly heat your home with a space heater. For example, in 2010, similar heating devices and equipment were the cause of over 57,000 reported house fires. From these fires, more than 300 deaths occurred, more than one thousand people and children were injured, and more than one billion dollars’ worth of damages occurred. When it comes to using space heaters, be sure to fully understand the risks and potential dangers that they can cause.

To avoid the risk of fires, injury, and damages, review these important safety tips regarding space heaters:

⚠ Use a heater that has a protective casing blocking the flame or heat source. This can help avoid contact with children, pets, and clothing.

⚠ Purchase a heater that has been certified and approved by a national recognized testing laboratory or corporation (i.e. Underwriter’s Laboratories Inc.). These products generally meet the safety standards and requirements for indoor heating devices such as this.

⚠ Use an appropriately-sized space heater for the square footage you need to heat. Do not use a heater too large for a room.

⚠ Place space heaters at least 3 feet away from curtains, drapes, blankets, furniture, and other flammable materials.

⚠ Keep space heaters away from water.

⚠ Be sure that everyone in the home or office thoroughly understands how to use and operate the space heater. This includes children, babysitters, co-workers, and any other person within the property.

⚠ If using a natural gas or kerosene space heater, keep all other doors open in the house to prevent pollutant build-up. It also promotes proper combustion. Vented heating devices also require ventilation for apposite combustion.

⚠ Gas space heaters should always come with a pilot safety valve.

⚠ Never attempt to light the pilot if you smell even a trace of gasoline.

⚠ Never leave a space heater on overnight or when you are not home.

⚠ Place the space heater on a leveled area where it cannot be knocked over or bumped.

⚠ Try not to use extension cords. If you do, make sure it is a heavy-duty brand with an equal or higher power rating as your space heater.

⚠ Always remember that space heaters are intended for temporary use only.

⚠ Unvented or kerosene space heaters are illegal in some states. Be sure to do your research. Be aware that trailers and mobile homes require specialized indoor space heating equipment. Only vented or fuel-fired heaters should be used in these types of properties.

Were You Injured By Fireworks?

Indianapolis Burn Injury Lawyer 317-881-2700

Indianapolis Burn Injury Lawyer 317-881-2700

Last week, millions of friends and family gathered together to commemorate our country’s independence by celebrating the Fourth of July. And of course, fireworks were the main attraction. From sparklers and bottle rockets, to firecrackers, motor shells, and more, fireworks come in a massive assortment that are available to the public for purchase every year. But depending on how they are manufactured and how they are used, fireworks can be a potentially dangerous hazard.

If you were injured by fireworks, you need to know your rights. Continue reading to learn about the laws surrounding firework injuries and accidents, and whether or not you could be entitled to compensation for your losses.

Firework Injuries and Accidents

Ranging from minor to major, and even fatal, firework injuries and accidents are unfortunately a common occurrence on this annual holiday. According to the United States Consumer Product Safety Commission (CPSC), in 2012 more than 8,700 firework-related injuries (2 of which were fatal) were reported by U.S. hospital emergency rooms. This included both firework handlers and spectators. Even more interesting, over 5,200 of the reported injuries took place between June 22 and July 22. A scarier discovery revealed that 30% of the reported injuries were minors under the age of 15, meaning children made up a considerable portion of the 2012 July 4th firework injuries. From those same reports, it was found that the most common body parts injured were the hands, fingers, legs, and head. And that the most common fireworks that caused the injuries were firecrackers, sparklers, bottle rockets, then motors.

Firework Laws

In all states, the CPSC regulates fireworks. This includes firework devices, the composition of fireworks, and their performance requirements. Some states do not allow consumer fireworks at all. These used to be known as “C-class” fireworks, and include roman candles, sparklers, bottle rockets, motors, shells, and more. Firework laws have changed in Indiana since 2006. To learn about these changes and to read the laws surrounding firework sales and usage, view the Indiana fireworks fact-sheet.

Firework Injury Claims and Lawsuits

Firework lawsuits are not so uncommon. People have sued firework manufacturers, companies, organizations that host firework shows, and even homeowners and tenants who host private firework celebrations. Winning a settlement for a firework injury depends on several factors, making each case different. And a victim must be able to prove that the opposing party: 1) had a duty of care, 2) breached that duty of care, and 3) their injuries were a result of that breach. For this reason, personal injury claims and lawsuits are highly-sensitive and complex. So it is critical to hire a personal injury lawyer after being injured by fireworks. They can examine the circumstances surrounding your accident, and then use their knowledge and experience to determine if you are entitled to compensation.
